Pricing
Prices of goods and other charges displayed on the GORDIUS MAK website are quoted in Australian Dollars and include GST. Prices of goods and other charges displayed on the GORDIUS MAK website are current at time of display. These prices are subject to change without notice by GORDIUS MAK. Additional delivery, handling or other charges may apply at our sole discretion.
Ordering
GORDIUS MAK reserves the right not to provide goods or services or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.
If you need to cancel an order, please contact GORDIUS MAK immediately via email at
order@gordiusmak.com. If we have not yet accepted payment for an order, cancellation of the order is within our sole discretion. If we have accepted payment for an order, any request to cancel or refund the order will not be accepted.
Delivery
All goods will be sent using Express Post Parcels for next-day delivery (terms & conditions apply) by the Australian Post. Delivery costs will be confirmed at the time of your order. It is your obligation to provide the correct delivery information at the time of ordering. Should there be any omission or error in the delivery information, GORDIUS MAK is not obliged to resend the order to the correct delivery destination at our expense. GORDIUS MAK cannot guarantee the date or time of delivery. GORDIUS MAK is not liable for any loss or damage caused by late delivery or cancellation of an order.
Should an order fails to arrive within the expected delivery timeframe and upon notification by you, we will instigate an investigation to be conducted by Australia Post. Such investigation can take up to 7 business days to reach a resolution. In the event of the package unable to be located, we will send a replacement to you immediately.
Replacements and Returns
All products by GORDIUS MAK are guaranteed with a 12-month warranty, which covers only genuine product faults or defects on materials and parts. All purchases from GORDIUS MAK are non-transferable and non-refundable unless genuinely defective.
The non-defective return of any product will be deemed acceptable only if the returned product is in its original condition, undamaged and un-used, and include all original packaging and proof of purchase. The customer will pay all postage and shipment charges for any non-defective return and replacement of product. All return requests must be lodged within 14 days of delivery unless defective. Once the above obligations are fulfilled by you and we have received your returned package in full, we will endeavour to supply replacement of another product nominated by you that is of equal value. However subject to availability, we reserve the right to provide substitute product that may be of equal or greater value.This policy is in addition to your statutory rights under the Trade Practices Act.
If a product is found to be genuinely defective, GORDIUS MAK will only accept return and provide full replacement of the defective product if:
- You have notified GORDIUS MAK via email at
order@gordiusmak.com within the warranty period; and
- You have sent back the defective product, along with its original packaging and proof of purchase to PO Box 12745, A'Beckett Street, Melbourne, Victoria, Australia 8006, and the returned package is received by GORDIUS MAK. Once the above obligations are fulfilled by you and we have received your returned package in full, we will endeavour to supply replacement of the exact product previous ordered at no cost to you; however subject to availability, we reserve the right to provide substitute product that may be of equal or greater value.
Authorised Resellers of GORDIUS MAK
GORDIUS MAK is not responsible for any arrangements that you make with any third-party reseller, which may involve, but not limited to, the ordering, delivery, refund, replacement, guarantee or warranty of products of GORDIUS MAK. Any of such arrangements are made within the sole discretion of third-party resellers and at your own risks. GORDIUS MAK is not liable for any loss or damage caused by any arrangement that you make with third-party resellers in any form of transaction involving products of Gordius Mak.
Release and Indemnity
You agree to waive any and all claims that you now have or may have in the future against GORDIUS MAK and associates of GORDIUS MAK which may relate to any transaction with GORDIUS MAK. You agree to indemnify and hold GORDIUS MAK harmless from and against any and all claims, loss or expense that may be incurred by GORDIUS MAK or associates of GORDIUS MAK which may relate to or are incidental to the performance of its duties as described in the above Terms and Conditions including all costs of defending itself against a claim by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceedings.
